フィリピン国籍の方を特定技能外国人として雇用するためには、在留資格の諸手続きとビザの手続きといった日本側での手続きに加え、フィリピン側でも一定の手続きが必要とされています。

今回は必要な手続きについて解説します！

申請から入国までの流れについてはこちらの記事で紹介しています。

ポイントは２つ

・POEAに認定された送り出し機関を経由すること

・POLOによる認証が必要であること

POLOへの提出書類の準備・提出・面接

フィリピンの制度上、受け入れ機関は必要書類をPOLO（ポロ）に郵送し、所定の審査を受け、雇用主（特定技能所属機関）としてPOEA（ピーオーイーエー）に登録される必要がります。

また、提出書類に関しては所定の様式に則って作成しなければなりません。

POLOでの審査の標準処理期間は、書類に不備がなければ15営業日以内とされています。

上記の審査を経た後、受け入れ機関の代表者の方または委任された従業員の方はPOLOに赴き労働担当官による英語での面接を受ける必要があります。

また、必要に応じてPOLOによる受け入れ機関のへの実地調査が実施されます。

POEAへの登録

フィリピンの制度上、受け入れ機関がPOLOにより自国民の雇用主として適正であると判断された場合、POLOから認証印が押印された提出書類一式及び推薦書（Recommendatory Memorandum）が受け入れ機関宛に郵送されることになっています。

受け入れ機関は送出し機関を通じてこれらの書類一式を本国のPOEAに提出することで、POEAにて雇用契約で定める予定である労働条件等の内容が確認され、受け入れ機関が雇用主としてPOEAに登録されるとともに、求人情報が登録されます。

POEAへの登録後、提出した雇用契約書のひな型にPOEAの認証印が押印され、送出し機関を通じて受け入れ機関に対して返送されます。登録の結果、受け入れ機関はフィリピン国籍の方の採用活動に着手することができます。

OEC（海外雇用許可証）の発行申請

フィリピンの制度上、OEC（Overseas Employment Certificate）はフィリピン側の手続を完了したことを証明する文書とされており、特定技能外国人として来日・就労を希望するフィリピン国籍の方は送出し機関を通じてOECの発行をPOEAに申請することになります。

FAQ

Q1.現地の送り出し機関を介さずにフィリピン国籍の方と雇用契約を結ぶことはできますか？

→フィリピンにおいては特定技能外国人の送出しにあたり、基本的には送り出し機関を介することが必須としています。例外も認められております。

Q2.POLOの審査を受けるにあたり、手数料などはかかりますか？

→POLOでの審査には手数料はかかりません。一方、POEAによる海外雇用許可証（OEC）の発行には手数料が必要です。

Q3.地方に住んでいるのですが、POLOの面接を受けるには東京に行かなければならないのでしょうか？

→受け入れ機関の方は、居住地を問わず東京にあるPOLOで面接を受ける必要があります。

Q4.日本の職業紹介事業者はフィリピン側の手続きに関与できますか？

→現在のところ日本の職業紹介事業者がPOLOでの審査に関する手続きに関与することは認められていません。POLOのホームページによれば、職業紹介事業者についてはPOEAから別途通達が発出される予定となっています。

Q5.特定技能外国人として雇用する予定の方がOECの取得を忘れた場合どうなりますか？

→OECはフィリピン国籍の方が特定技能外国人としてフィリピンを出国する際の必要書類とされています。OECを取得しなかった場合フィリピンを出国することはできないので、一時帰国などもできないことになります。

[Specified Skills] [Technical Intern Training] Procedures for applying for POLO & POEA [Philippines]

In order to hire a Filipino as a Skilled Foreign National, certain procedures are required on the Philippine side in addition to the procedures on the Japanese side, such as procedures for the status of residence and visa.

There are two important points:

1. The paperwork must be done via POEA approved sending agencies
2. The authentication by POLO is required

Preparation of Documents to be Submitted to POLO, Submission and Interview

Under the Philippine system, the Accepting Organization is required to mail the necessary documents to the POLO for a review and registration with POEA as an employer (institution where Specified Skilled Worker will be employed).

In addition, you must prepare the documents in the prescribed format.

The standard processing period for a POLO review is 15 business days or less if the documents are satisfactory.

After the above review, the representative or authorized employee of the Accepting Organization must go to the POLO for an interview in English by a labor officer.

In addition, the POLO will conduct on-site inspections of Accepting Organization as necessary.

Registration with POEA

Under the Philippine system, if POLO determines that a Accepting Organization is a suitable employer for its citizens, a set of documents and a Recommendatory Memorandum stamped by POLO will be mailed.

The Accepting Organization submits a set of these documents to the POEA through the sending institution, and the contents of the working conditions and other matters to be stipulated in the employment contract are confirmed in the POEA, and the Accepting Organization is registered as an employer in the POEA, and job information is registered.

After registration with POEA, a POEA seal is affixed to the model of the employment contract submitted, and it is returned to the accepting organization through the sending institution. As a result of the registration, the accepting organization will be able to start recruiting Filipino nationals.

Application for issuance of OEC (Overseas Employment Permit)

Under the Philippine system, the Overseas Employment Certificate (OEC) is a document that proves the completion of the procedures on the Philippine side. Filipino nationals who wish to come to Japan and work as a Specified Skilled Worker must apply for the issuance of an OEC to POEA through the sending organization.

Q1. Is it possible to sign an employment contract with a Filipino national without going through a sending agency in the Philippines?

->In the Philippines, it is essential to send skilled foreign nationals through a sending organization.

Q2. Is there any fee for POLO?

->There is no fee for POLO. On the other hand, POEA’s issuance of an overseas employment permit (OEC) requires a fee.

Q3. I live in a rural area, do I have to go to Tokyo to get an interview for POLO?

->The accepting organization must have an interview at POLO in Tokyo regardless of where they are located.

Q4. Can Japanese employment agencies be involved in the procedures in the Philippines?

->At present, Japanese employment agencies are not allowed to participate in procedures related to POLO reviews. According to the POLO website, POEA will issue a separate notification regarding employment agencies.

Q5. What happens if a person who plans to work as a skilled foreign national forgets to obtain an OEC?

->OEC is a necessary document for a Filipino national to leave the Philippines as a designated skilled foreign national. If you do not obtain OEC, you will not be able to leave the Philippines.
