【特定技能】脱退一時金について【技能実習】

今回は年金の脱退一時金について解説いたします。

脱退一時金は、日本国籍を有しない方が、国民年金、厚生年金保険（共済組合等を含む）の被保険者（組合員等）資格を喪失して日本を出国した場合に請求することができます。ただし、日本を出国後2年以内に請求する必要があります。

なお、脱退一時金の支給を受けるためには一定の要件があり、そのすべての要件を満たす必要があります。要件は以下の通りです。

• ①日本国籍を有していない

• 国民年金の保険料納付済期間等※ の月数又は厚生年金保険（共済組合等に加入していた期間を含む）が6 月以上ある

※国民年金の保険料納付済期間等国民年金の第１号被保険者としての保険料納付済期間の月数、保険料 4 分の 1 免除期間の月数の 4 分の 3 に相当する月数、保険料半額免除期間の月数の 2 分の 1 に相当する月数、及び保険料 4 分の 3 免除期間の月数の 4 分の 1 に相当する月数を合算した月数のことをいいます。

• ③日本に住所を有していない

※市区町村に転出届を提出したうえで、再入国許可・みなし再入国許可を受けて出国する方は請求することができます
が、転出届の提出がない場合、再入国許可の有効期間が経過するまでは国民年金の被保険者とされることから、脱
退一時金は請求できませんのでご注意ください。

• ④ 年金（障害手当金を含む）を受ける権利を有したことがない。

今般の制度改正により、脱退一時金の支給額計算に用いる支給上限月額の見直しが行われ、令和３年４月より36ヶ月（３年）から60ヶ月（５年）に引き上げられます。

つまり、日本で就労している外国人は支払った年金を５年分まとめて返してもらえるが、５年を超えた納付に関してはカウントされないということです。

コロナウイルス感染症の影響で技能実習修了後に帰国せず特定技能へ資格を変更した外国人の方は特定技能が２年経過する前に一度帰国をして脱退一時金を受け取る方がいいでしょう。

[Specified Skills] Lump-sum Withdrawal Payment [Technical Intern Training]

This time I will explain the lump-sum withdrawal payment of pension.

A lump-sum withdrawal payment can be claimed in the event that a person who does not have Japanese nationality loses the status of insured person (member, etc.) of the national pension or welfare pension insurance (including mutual aid associations, etc.) and leaves Japan. However, you need to make a claim within two years of leaving Japan.

In order to receive the lump-sum withdrawal payment, there are certain requirements, and all of them must be met. The requirements are as follows:

1. You don’t have a Japanese nationality
2. The number of months during which the national pension premiums have been paid*, or the number of months during which the employees’ pension insurance (including the period during which the employee has been a member of a mutual aid association) has been paid is six months or more.

*The sum of the number of months during which insurance premiums have been paid as the first insured person of the National Pension, the number of months equivalent to three-quarters of the number of months in the exemption period of one-fourth of the insurance premiums, the number of months equivalent to one-half of the number of months in the exemption period of one-fourth of the insurance premiums, and the number of months equivalent to one-fourth of the number of months in the exemption period of three-fourth of the insurance premiums.

3. You don’t have address in Japan

*If you have received a re-entry permit or deemed re-entry permit after submitting a notification of moving out to your municipality, you can file a claim. However, if you have not submitted a notification of moving out, you will be considered as an insured person of the national pension until the valid period of the re-entry permit expires, so please be aware that you cannot file a claim for a lump-sum withdrawal payment.

4. You have never had the right to a pension (including disability allowance).

Due to the revision of the system, the maximum monthly payment amount used to calculate the lump-sum withdrawal benefit will be revised and increased from 36 months (3 years) to 60 months (5 years) from April 2021.

This means that foreigners working in Japan can get their pension back for five years at a time, but payments over five years are not counted.

Foreigners who did not return to their home country after completing the technical intern training due to the COVID-19 and changed their qualification to a specified skill should return to their home country once and receive a lump-sum withdrawal payment before the specified skill passes for two years.
