【一時帰国】外国人社員の帰国について

雇用契約の終了や一時帰国など、様々なシーンで「外国人の帰国」に係る業務が発生すると思います。

特に一時帰国については手続きをしておかないと在留資格認定からやりなおし！！なんてことも…

今回はシーン別に帰国時に必要な手続きについて説明します。

単純出国

外国人が雇用契約の満期や、本人都合での退職により出国をすることがあります。

この場合には帰国以降、日本での活動の継続はないものとなります。以下の２つをもって帰国していきます。

①日本での住民票がない

②年金の被保険者資格の喪失

各種届出には時間がかかるため、早めに準備しておきましょう。

・健康保険の被保険者証の返納

外国人本人から保険証を返納してもらい、資格喪失届を提出します。

・雇用保険の資格喪失手続き

離職証明書をハローワークへ送付し、離職票を交付します。※本人の署名が必要なので帰国前に手続きが必要！

・源泉徴収票の発行

・入管への届出

雇用契約の終了や登録支援機関との委託契約の終了など各種届出が必要になります。必要になる在留資格は、特定技能、技術・人文知識・国際業務、技能、介護、高度専門職1号/2号、技能、研究、興行の在留資格です。

一時帰国

在留資格・有効な旅券・在留カードを所持していることを条件に、手続きを省略して再入国することができます。

その場合にはみなし再入国もしくは再入国許可申請を行う必要があります。

Foreign employees temporarily returning to their home country

There are many situations where foreign go home, such as in the case of termination of their employment contract or just temporary returning home.

Especially for temporary return, if you don’t go through the procedures, you will have to start again from the residence status authorization.. Oh no!!

Here, I will explain the necessary procedures for returning home depeding on the different situations.

Leaving For Good………….

Foreigners may leave Japan due to the expiration of their employment contract or if they resign.

In this case, they will not continue their activities in Japan after returning home. They will return home with the following two things:

1. With no certificate of residence in Japan.
2. Forfeiture of pension eligibility. It takes time to submit various documents, so you should prepare them way in advance.

Give back a Certificate of Insured Person (for health insurance).

The foreigner themselves need to return the insurance card and submit for a certificate of losing a qualification for health insurance.

Discqualification procedures for employment insurance.

Send a letter of resignation to Hello Work and get a letter of resignation issued. *It needs to be signed by the foreign worker, so please go through the procedure before you go back to your country!

Issuance of a Withholding Record

Notification to Immigration

You will need to submit various notifications such as termination of employment contract or contract with registered support organization.

The required status of residence is “Specified Skilled Labor”, “Specialist in Humanities/ International Services”, “Skilled Labor”, “Nursing Care”, “Highly Skilled Professional (i)”, “Highly Skilled Professional (ii)” “Researcher” and “Entertainment”.

Temporary Return…………..

On the condition that you have a status of residence, a valid passport, and a residence card, you can skip the procedures and re-enter Japan easily.

In that case, you need to apply for re-entry permit.
